Here’s a warning for real estate agents, one they should take to heart: A New Jersey court has ruled that agents can be sued for mistakenly telling buyers that a house was in a good school district when, in fact, it was in a less prestigious district, reports the Los Angeles Times.
A New Jersey appeals court has reinstated the buyers’ lawsuit, saying that they were entitled to rely on those representations and that they agents could not write them off as “mere puffery” - the contract law term for stuff the seller tells you that you’re supposed to be skeptical enough to know is just talk and not part of the contract. “Buyers are entitled to expect that the Realtors who are assisting them in their housing search will know where the houses are located,” the judges wrote.
Of course, buyers here don’t have that school district problem but it’s no secret that homes are advertised as and sold because they are in the zone for particular schools like Green Valley and Palo Verde high schools. And agents have a tougher time here because the edges of the zones keep moving as new high schools are created to accommodate new subdivisions. So Realtors beware!
